An Analysis of Article 36.3 of Free Legal Aid

Article 36.3 of the Free Legal Aid Act imposes on the right holder the obligation to pay the costs incurred in his or her own representation and defense if he or she has obtained an economic benefit as a result of the litigation and it is not possible to pass them on to the other party. The purpose of this study is to analyze the content and scope of this article, interpret it, and address the questions it raises.
